Changes have been made to the Licence of The Nag's Head pub in Henley-in-Arden following a hearing of Stratford-on-Avon District Council's Licensing Panel.
At last week's, Licensing Act 2003 review hearing, the Licensing Panel removed the exemptions allowed under Section 177 and 177a, which allow certain regulated entertainment to be provided without the need for a licence.
In addition, the Panel also imposed a number of conditions to control the amount of events taking place outside, the management of customers and the level of noise from live music played inside.
The review was requested by the Senior Environmental Protection Officer, Ben Ellis, following several noise complaints from the pub over the summer of 2022, followed by further complaints of noise and disturbance in November and December.
During the consultation period for the review Senior Licensing Officer, Vikki Goodman, in her capacity of Responsible Authority for Licensing for Stratford on Avon District Council and Niki Moultrie of Warwickshire Fire and Rescue Service provided information supporting the review, outlining concerns and failings to promote the licensing objectives.
The review followed verbal advice, visits and letters to the premises reminding them of their licensing conditions and permission by the District Council's Environmental Health and Licensing Team.
Sound recordings and video evidence were presented at the Panel Hearing to illustrate the volume of noise that was being generated at the events in the rear of the premises. An audit following an inspection by Warwickshire Fire and Rescue outline several failings in relation to fire safety, the most concerning being that, at the time of their inspection, there was no fire risk assessment in place for the outside area.
