Post Decision EIA Regulations 24/01334/REM Phase 2d 2e infrastructure STATEMENT Statement in accordance with Regulation 24 of the Town and Country Planning (Environmental Impact Assessment) Regulations 2011

- 24/01334/REM Reserved Matters relating to Secondary Road and drainage infrastructure serving Phase 2d Parcels A5, A6, B3, B4 and B5 and Phase 2e Parcel B6. The Outline permission was granted 14 December 2017. Regulation 24 of the Town and Country Planning (Environmental Impact Assessment) Regulation 2011 requires the Local Planning Authority to inform the public and Secretary of State of the final decisions in respect of planning applications which are accompanied by an Environmental Statement. This statement has been produced to comply with these regulations. The Local Planning Authority has given due regard to the Town and Country Planning (Environmental Impact Assessment) Regulations 2011 and under the requirements of Regulation 8 of the 2011 Regulations the Local Planning Authority has concluded that the information contained within the Environmental Statement submitted with the original outline application (15/00976/OUT) together with the information submitted with the current Reserved Matters application is adequate to assess the environmental effects of the development on the environment. This statement relating to the main reasons and considerations in respect of the reserved matters decision has been prepared under Regulation 24 of the Town and Country Planning (Environmental Impact Assessment) Regulation 2011. Reserved Matters Approval was issued by the District Council as Local
Planning Authority on 10 January 2025. (i) The Delegated report and decision notice can be viewed on the District Council's web site under application reference 24/01334/REM. (ii) The main considerations undertaken as part of the assessment of the planning application were as follows (and are as detailed in the delegated report): Principle of Development; Access Arrangements; Highway Matters; Scale;
Appearance; Accessibility; Movement; Community Cohesion; Impact on neighbours amenity; Climate Change Measures; Landscaping; Drainage; Heritage Assets; Ecology; Referral to the Secretary of State and Conclusion. A public consultation exercise (site notices and press notice) was undertaken in respect of the application and all responses received in respect of this were given careful consideration by the District Council in the determination of the reserved matters application. (iii) The principal impacts of the development which were required to be assessed are to be controlled by the imposition of conditions and these supplement the conditions and legal obligations imposed at outline application stage under reference 15/00976/OUT which can be viewed on the District Council's web site. The assessment of
all the relevant issues is covered in the delegated report which can be viewed on the District Council's web site under application reference 24/01334/REM.(iv) There is a right to challenge the validity of the planning decision under Section 288 of the Town and Country Planning act 1990 and this should be made to the High Court within 6 weeks from the date the reserved matters approval is issued by the Local Planning Authority.
