Following legal advice Stratford-on-Avon District Council has applied to Stratford-upon-Avon County Court for an injunction against the unauthorised traveller encampment at the Darlingscott cross roads on the A429, near Shipston-on-Stour, Warwickshire.

The terms of the injunction are wide ranging and include:

  • the cessation of the unauthorised residential occupation of the caravans and mobile homes;
  • removal of the caravans and mobile homes;
  • removal of the operational development including the fencing, hardstanding and any structures and
  • removal of any services.

It is anticipated that the application for the injunction will be considered at a hearing within 10 to 12 weeks of the application date.  In the meantime Stratford-on-Avon District Council has applied for an interlocutory injunction*.

When a hearing date for these has been decided there will be a further press statement.

Meanwhile the terms of the Temporary Stop Notice are continuing to be closely monitored to ensure no further caravans and mobile homes are brought on to the site.

The purpose of these actions is to bring the existing unauthorised use of the site to an end.

*An interlocutory injunction is an interim measure that has been applied for pending final determination of the full application.
