Nags Head, Studley fined for breach of Licence Conditions

Stratford-on-Avon District Council has been awarded £1,222.45 costs following a court case at Stratford-on-Avon Magistrates Court on 19 August 2010 and fined Richard Barrell of Redditch Road, Studley and Robin Davidson of Boulton Lane, Redditch a total of £2,900.

The Nags Head Inn at Redditch Road, Studley had been the subject of numerous complaints regarding excessive noise and disturbances and conditions were put on the premises licence by the District Council's Liquor Licensing Committee.

When Licensing and Environmental Health Officers from the District Council paid two visits in October 2009 they found that the pub was in breach of two of these conditions, contrary to the Licensing Act 2003.  Firstly the pub was required to use a noise limiter to control the level of amplified music and it was found that the limiter was being bypassed completely and that noise levels were uncontrollable, with music being heard 120 metres away. 

The second breach related to the condition where there was to be no admission of customers after 11pm and no one was to be allowed outside after that time, except for a maximum of 6 smoking customers. During the 2009 Council inspection numerous new customers were seen being admitted after 11pm and a group of 30 people were outside the pub on one occasion, causing a danger to traffic. 

Cllr Simon Jackson, Environment Portfolio says: "This is a good result following some sterling work from our own District Council Licensing, Environmental Health and Legal teams.  It's essential that people who run licensed premises fulfill their duty of care to both customers and the wider community. That's why we take any breach of licensing conditions very seriously in Stratford District.  Licensees must be responsible and adhere to their licence conditions, or they risk prosecution and as in this case a hefty fine."

Mr Davidson is the designated premises supervisor responsible for the day to day running of the pub and Mr Barrell is the manager.
