Update on land at Rainbow Nurseries, Welford-on-Avon

Stratford-on-Avon District Council has decided not to currently take any formal action against the family that has moved, in breach of planning regulations, onto the site at Rainbow Nurseries, Welford-on-Avon.

District Council Planning and Enforcement Officers visited the site on Monday 31 January to assess the situation.

Officers have found that the level of harm is not sufficient to justify any formal action of either an injunction or a temporary stop notice at this time.  There is also no harm to highway safety or to visual amenity that would justify formal action and there is no information to suggest that any further works are intended at the site.

District Council Enforcement Officers will be monitoring the site to make sure no further works take place and that no other people move onto the site.  If this does change then the situation will be reviewed immediately.

A special meeting of the District Council's Audit and Regulatory Committee is currently being organised at the earliest opportunity to discuss this matter.

  • During the weekend of 29 and 30 January 2 caravans along with 2 portaloos were moved onto Rainbow Nurseries at Welford-on-Avon and the existing hardstanding has also been re-surfaced and a 1.2m high fence has been erected along part of the site.
  • A planning application 10/01796/FUL for 'Change of use of part of garden nursery to use as residential caravan site for two gypsy families with a total of 4 caravans and associated works' was refused by the District Council in December 2010.
