Cank Farm, Tanworth-in-Arden

On 17th October 2011 Stratford-on-Avon District Council was successful in obtaining a mandatory and prohibitory injunction against Summer Poultry Products Ltd, Summers Holdings Ltd and the Directors, at Birmingham High Court, relating to Cank Farm at Tanworth-in-Arden.

The use of unauthorised buildings at this site has been the subject of District Council action for many months and this culminated in a decision made by the District Council's Audit and Regulation Committee to escalate the matter to formal court proceedings.

Councillor Ron Cockings, Vice Chair of the Audit and Regulation Committee said: “Enforcement action is taken only where necessary and in this instance the operators had been given ample opportunity to comply with Enforcement Notices which would have removed the need to take this matter to court. The operators must now demolish these structures or face further sanctions from the court including the possibility of imprisonment.

“I am also very happy that the efforts of the District Council in supporting the concerns of the residents have now been recognised by the High Court."

The Court ordered that:

1. The Defendants (and/or each of them, and/or their servants or agents or otherwise) be prohibited from undertaking any further development on site without planning permission.
   
2. The Defendants demolish the unauthorised 'Holding Chill' development extension on the Land in accordance with the requirements of the Enforcement Notice issued by the District Council on 22 June 2009 by 4pm on 19 January 2012.  
   
3. The Defendants remove or demolish another unauthorised development remaining on the Land by 4pm on 19 January 2012.
   
4. The Defendants (and/or each of them, and/or their servants or agents or otherwise) be prohibited from utilising any development on the Land that does not have planning permission or is otherwise immune from enforcement action from 4pm on 19 January 2012.
   
5. The Defendants to pay the District Council's costs of this claim on a standard basis.
