A public inquiry starts next week on Wednesday 4 February, following an appeal by Chris Swan and Spitfire Properties LLP against the decision of Stratford-on-Avon District Council to refuse planning permission for the development of land at Kissing Tree House, Alveston, Stratford-upon-Avon.

The appeal relates to proposals for the construction of 15 dwellings, new access, open space, landscaping with associated infrastructure and creation of a new church car park (with separate access) and extension to existing church yard cemetery (for ashes only burials) submitted under planning application reference 13/02806/FUL.

Stratford-on-Avon District Council refused the planning application on the following (summarised) grounds:

  • Harm to designated heritage assets
  • Harm to landscape character and the visual amenity of the area/countryside
  • Inappropriate design and form of development
  • Insufficient mitigation to off-set the impact on local  infrastructure and
  • Having regard to economic, social and environmental considerations the proposal is considered to be an unsustainable form of development.


The inquiry is expected to last for 5 days (4 to 6 February and 10 to 11 February) and will be held at The Falcon Hotel, Chapel Street, Stratford-upon-Avon CV37 6HA starting at 10am.  A Government Planning Inspector will preside over the inquiry.

Members of the public may attend the inquiry and express their view – at the discretion of the inspector.
